1.         This is a submission on an application for coastal permits from Auckland City Council to construct a new stormwater outfall at Sloanes Bay and Short Street (off Marine Parade), Herne Bay. 

2.         The proposed activity is located at the interface of the territorial local authority and the coastal marine area, Short Street, Herne Bay.

The applications are identified as –

·                No. 28873 – Coastal permit to construct new stormwater outfall structure at Sloanes Bay

·                No.  28871 – Coastal permit to occupy land in the coastal marine area

·                No. 28964 – Coastal permit to discharge untreated stormwater into the coastal marine area

3.         The specific parts of the application that this submission relates to are:

·                The submission relates to the application in its entirety.

4.         My submission is that I oppose the proposal for the following reasons:     

            (a)        The application documents fall well short of the required assessment of environmental effects with supporting technical reports to address the assessment criteria of the Regional Plan: Coastal.

            (b)        There is no assessment of environmental effects and accordingly the application documentation fails to meet the basic provisions of s.88 of the Act.

            (c)        The applicant has failed to provide a thorough hydrological study of the impact of the discharge of uncontrolled stormwater at this location in the coastal marine area.  The actual and potential adverse effects of the discharge in association with the natural coastal processes occurring at this locality have not been identified or assessed to the standard required by the Regional Plan:  Coastal.

            (d)       Adverse effects of high probability and high impact will occur with respect to the heritage Richmond Cruising Club building, the sandy foreshore amenity of Sloanes Beach and the inter-tidal coastal environment in the immediate vicinity of the outfall.

            (e)        The applicant has failed to provide an analysis to demonstrate that this proposal is the best practical option to serve the purpose of the application, taking into account the existing stormwater outlet and other more suitable locations which do not involve the only sandy beach in this vicinity.

            (f)        Overall, the proposal creates uncontrolled adverse effects within the coastal marine area on a beach used regularly by local people as a foreshore amenity.

            (g)        Accordingly, the proposal is contrary to the objectives, policies and rules of the Auckland Regional Plan: Coastal.

            (h)        The proposal fails to meet the purpose and principles of the Act because it does not achieve the sustainable management of this sensitive urban, coastal environment which has significant recreational, visual and ecological amenity values.

5.         I seek the following decision from the consent authority:

·         Refuse consents and permits to the proposal in their entirety. 

6.         I wish to be heard in support of this submission.

7.         If others make a similar submission, I will consider presenting a joint case with them at a hearing.
